“Moorts Platform” is a registered business name owned and operated by Moorts Holdings Pty Ltd (ABN 16 683 351 662). All references to "Moorts," "we," or "the platform" refer to Moorts Holdings Pty Ltd trading as Moorts Platform.
 

MOORTS provides its services (described below) to you through the MOORTS website and associated mobile applications, platforms, and related services (collectively, the "Service"). These Terms of Service ("Terms") form a legally binding agreement ("Agreement") between you and MOORTS , its affiliates, officers, directors, employees and representatives, governing your use of the Service in Australia. By accessing or using the Service, you confirm that you have read, understood and agree to be bound by this Agreement.
 

We may update these Terms from time to time at our sole discretion. If we do so, we will update the date at the top of this page and post the revised Terms on the Service. Where required by law or where changes are material, we will notify you in advance. Your continued use of the Service after any such updates constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.

By using this information, you agree to indemnify and hold harmless MOORTS Holdings Pty Ltd from any liability, loss, or damage arising from your reliance on this content.
 

1. Description of the Service


MOORTS is an online marketplace operating in Australia that connects individuals who prepare meals, such as neighbourhood chefs, food enthusiasts, and independent cooks (“Sellers”), with individuals and organisations looking to purchase ready-made food (“Customers”). Sellers may list, offer, prepare, and arrange delivery of meals and food items (“Meals”) via the platform. All purchases are made directly between the Customer and the Seller. MOORTS does not sell or prepare any food items itself.
 

MOORTS may facilitate dispute resolution between Customers and Sellers but is not a party to any transaction between them and does not and cannot guarantee:
 

  • The availability, quality, safety, or legality of the Meals;

  • The accuracy of any listings or Seller information;

  • That any Seller will deliver Meals as described or within a specific timeframe;

  • That Customers will complete a purchase or pay for an order.
     

MOORTS is not a food business. Sellers operate as independent business owners, not as employees, agents, or representatives of MOORTS. Sellers are solely responsible for complying with applicable Australian laws, food safety standards (including local council and state regulations), insurance requirements, and for ensuring their meals are safe, accurately described, and delivered as agreed.
 

MOORTS does not verify or guarantee the credentials or offerings of any Seller. We accept no liability for any damages or losses arising from food sold or listed on the Service.
 

2. Delivery


Sellers or Customers may choose to use third-party delivery services ("Couriers"). These Couriers are independent and not affiliated with MOORTS. We are not responsible for their conduct, reliability, or the condition of any delivery.
 

3. Registration and Account Security


You may be required to register and create an account. You agree to:
 

  • Provide accurate and complete information;

  • Keep your account details secure;

  • Notify MOORTS immediately of any unauthorised use.
     

MOORTS reserves the right to suspend or terminate accounts that breach these Terms or where necessary for community safety.
 

4. Mobile Services


Standard mobile charges may apply. If you change or deactivate your number, you must update your account to prevent misdirected communications.
 

5. Communications and Notifications


By registering, you consent to receive messages from MOORTS (including marketing) via email, SMS, or app notification. You can opt out of marketing communications at any time.
 

6. Modification or Termination of the Service


MOORTS may modify or discontinue any part of the Service without notice. We are not liable for any loss resulting from changes or termination.
 

7. Eligibility


You must be at least 18 years old to use the Service. The platform is not available to those under legal age or previously removed from the platform.
 

8. Acceptable Use & Content Responsibilities


You are responsible for content you post. You must not:
 

  • Violate any law (e.g. Spam Act 2003, ACL, Food Act 1984 (Vic));

  • Upload misleading, harmful, or offensive content;

  • Harass or abuse others;

  • Circumvent platform processes;

  • Sell food without proper licenses.
     

9. Ingredients, Allergens, and Health


Sellers must disclose ingredients and allergens. MOORTS is not liable for incorrect information or allergic reactions. Cross-contamination may occur.
 

10. Insurance Requirements


Sellers must obtain public and product liability insurance compliant with Victorian food safety regulations.
 

11. Reviews


Users may leave reviews, which must be truthful, respectful, and not violate laws or platform policy. MOORTS may moderate or remove reviews at its discretion.
 

12. Platform Role
 

MOORTS is a technology platform. We do not control or supervise Sellers. Use profiles, reviews, and safety tools to assess risks.
 

13. Seller Independence


Sellers are independent businesses. They are responsible for tax, food compliance, and business insurance. Sellers must not misrepresent affiliation with MOORTS.
 

14. Verification and Safety


We may request ID or documents. Alcohol sales must follow licensing rules. Orders may be cancelled if unsafe or suspicious.
 

15. International Use
 

MOORTS is only for use in Australia. You are responsible for legal compliance in your jurisdiction.
 

16. Commercial Use


You may not commercially exploit any part of the Service without written consent.
 

17. User Warranties


All users must:
 

  • Use their real name/business name;

  • Be legally capable of entering contracts;

  • Comply with Australian laws;

  • Treat others respectfully.
     

Sellers must:
 

  • Hold valid permits;

  • Use safe food practices;

  • Honour commitments;

  • Comply with local council requirements.
     

18. Fees and Payments
 

MOORTS charges platform fees as per its published Fee Policy. All charges are in AUD. Customers pay for meals, GST, delivery, and platform service fees. Sellers pay commission and are responsible for their own tax obligations.
 

🔄 Refunds and Exchanges
 

i). Customer-Initiated Cancellations
 

Customers may cancel their booking within the specified cancellation window (outlined at time of booking) to receive a full or partial refund, subject to the individual chef’s policy and preparation status. Late cancellations may not be eligible for a refund.
 

ii). Chef-Initiated Cancellations
 

If a chef cancels a confirmed booking, customers will be offered a full refund or the option to reschedule with the same or another available chef. MOORTS will assist in facilitating this process but is not responsible for outcomes beyond its control.
 

iii). No Exchanges for Hygiene Reasons
 

Due to the nature of food services, we do not offer exchanges. Meals and experiences are non-returnable and non-exchangeable once delivered or commenced, unless proven to be defective or unsafe.
 

iv) Unsatisfactory Service or Issues
 

If you are dissatisfied with your order or experience, please contact MOORTS support within 48 hours of the booking date. We will assess the issue and may offer compensation, partial refund, or credit at our discretion.
 

v). Refund Processing
 

Approved refunds will be processed via Stripe to the original payment method within 3–7 business days, depending on the customer’s bank processing time.
 

vi). Chargebacks and Disputes
 

Unjustified chargebacks may result in account review or suspension. We encourage users to contact our support team before initiating a payment dispute.
 

19. Packaging and Promotions


Sellers may purchase packaging through MOORTS. Promotional credits may be offered at our discretion and are non-transferable.
 

20. Distribution Channels


Use of our mobile apps may be subject to additional terms from platforms like Apple or Google. MOORTS is not responsible for app content and support.
 

21. Media, Licensing & IP


You grant us the right to use content and images for promotional purposes. We own the IP for our platform. You retain ownership of your content but grant us a non-exclusive license to use it.
 

22. Copyright and IP Infringement

23. External Sites and Integrations
 

MOORTS is not responsible for third-party sites or services (e.g. delivery or social login providers). Review their policies separately.
 

24. Indemnity and Release


You agree to indemnify MOORTS against all claims arising from your use of the Service. This includes legal costs, losses, and liability from content you submit or actions you take.
 

25. Disclaimer of Warranties
 

MOORTS provides the Service "as is". We do not guarantee accuracy, reliability, or continuous availability. This does not affect your rights under Australian Consumer Law.
 

26. Limitation of Liability


To the extent allowed by law, MOORTS limits its liability to the greater of AUD $100 or your fees paid in the last six months. Some rights under Australian law cannot be excluded.
 

27. Governing Law


These Terms are governed by the laws of Victoria and the Commonwealth of Australia. You agree to the exclusive jurisdiction of courts in Victoria.
 

28. Dispute Resolution


 

  1. Negotiation – Contact supports@moorts.com.au

  2. Mediation – Optional; under the Resolution Institute, held in Melbourne.

  3. Court – If unresolved, legal proceedings may be initiated in Victorian courts. Urgent injunctive relief may be sought anytime.
